The main relevant criteria are, minimum wage applies if "they only have a limited right to send someone else to do the work (subcontract)" and "they have to turn up for work even if they don’t want to", see gov.uk/employment-status/worker and gov.uk/employment-rights-for-interns - usually, UK for-profits can have unpaid volunteers so long as those volunteers don't have essential duties that only that one specified person can perform. | |

Also note that if someone, or some group of people gives a list of volunteer moderators to the DOL, and the DOL contacts the person to invite them to a phone interview, the individual can decline to participate. // I forgot to say, I believe SE has an office in London. I hope someone will look into the labor laws in the EU and let us know what is possible there. | |

One quick concern though - is there a danger of non-US moderators who do some moderation while in the US on non-business visas (e.g. while on holiday/vacation), who respond to DOL queries honestly and in good faith, then finding themselves in legal trouble, for "working" in the US without a work permit? | |
